THESE TERMS AND CONDITIONS CONSTITUTE A LEGAL AGREEMENT BETWEEN YOU (“YOU” OR “YOUR”) AND THE GENTS STORE, OPERATED BY TGP FRANCHISING LLC (“WE,” “US,” “OUR,” OR “THE GENTS STORE”). BY ACCESSING OR USING OUR WEBSITE, YOU AGREE TO BE BOUND BY THESE TERMS. IF YOU DO NOT AGREE TO THESE TERMS, DO NOT USE OUR WEBSITE OR SERVICES.

1. Purpose

(a) The Gents Store allows customers to purchase a variety of products from different brands and suppliers through a drop shipping model, which is facilitated by a third-party application called Carro. By using our website and services, you agree to these Terms of Service and any additional terms and conditions provided by our third-party partners, including Carro.

(b) The Gents Store is headquartered in Texas, United States, and operates this e-commerce platform for the sale of products, which may be supplied by third-party vendors. The Terms of Service govern your use of our website and any purchase made through our platform.

2. Account Access

(a) Account Creation. To access certain features of our website, you may be required to create an account. You agree to provide accurate, current, and complete information during the registration process and update such information to keep it accurate and current.

(b) Account Security. You are responsible for maintaining the confidentiality of your account credentials and are fully responsible for all activities that occur under your account. You agree to immediately notify us of any unauthorized use or suspected unauthorized use of your account.

(c) Cancellation. You may cancel your account at any time by contacting us at concierge@thegentsplace.com. Upon cancellation, we may delete your account and all associated information.

3. Pricing and Orders

(a) Pricing Accuracy. While we strive to provide accurate pricing information, errors may occur. If an item is listed at an incorrect price due to a typographical error or an error in pricing information received from our suppliers, we reserve the right to refuse or cancel any orders placed for that item.

(b) Right to Refuse. The Gents Store reserves the right to refuse or cancel any order for any reason, including errors in pricing or product information. If your order is canceled after your payment has been processed, we will issue a full refund for the amount charged.

4. Use of Services

(a) You agree to use our services only for lawful purposes. You will not use our services to:

  • Engage in any fraudulent or deceptive activities.
  • Violate any applicable local, state, national, or international laws.
  • Send unsolicited advertising or promotional material (spam).
  • Attempt to gain unauthorized access to our systems or interfere with our website’s functionality.

(b) We reserve the right to terminate your access to our services if we determine, in our sole discretion, that you have violated these Terms of Service.

(a) Our website may feature products and services provided by third parties through Carro or other partnerships. These third-party products are subject to the terms and conditions provided by the respective vendors. The Gents Store does not assume responsibility for any third-party products or services.

(b) Any disputes related to third-party products or services should be directed to the relevant third-party vendor.

6. Mobile Message Service Terms

(a) The Gents Store and The Gents Place mobile message service (the "Service") is operated by The Gents Place (“The Gents Place”, “we”, or “us”). Your use of the Service constitutes your agreement to these terms and conditions (“Mobile Terms”). We may modify or cancel the Service or any of its features without notice. To the extent permitted by applicable law, we may also modify these Mobile Terms at any time and your continued use of the Service following the effective date of any such changes shall constitute your acceptance of such changes.

(b) By consenting to The Gents Place’s SMS/text messaging service, you agree to receive recurring SMS/text messages from and on behalf of The Gents Place through your wireless provider to the mobile number you provided, even if your mobile number is registered on any state or federal Do Not Call list. Text messages may be sent using an automatic telephone dialing system or other technology. Service-related messages may include updates, alerts, and information (e.g., order updates, account alerts, etc.). Promotional messages may include promotions, specials, and other marketing offers (e.g., cart reminders).

(c) You understand that you do not have to sign up for this program in order to make any purchases, and your consent is not a condition of any purchase with The Gents Place. Your participation in this program is completely voluntary.

(d) We do not charge for the Service, but you are responsible for all charges and fees associated with text messaging imposed by your wireless provider. Message frequency varies. Message and data rates may apply. Check your mobile plan and contact your wireless provider for details. You are solely responsible for all charges related to SMS/text messages, including charges from your wireless provider.

(e) You may opt-out of the Service at any time. Text the single keyword command STOP to +1-855-338-0027 or click the unsubscribe link (where available) in any text message to cancel. You'll receive a one-time opt-out confirmation text message. No further messages will be sent to your mobile device, unless initiated by you. If you have subscribed to other The Gents Place mobile message programs and wish to cancel, except where applicable law requires otherwise, you will need to opt out separately from those programs by following the instructions provided in their respective mobile terms.

(g) We may change any short code or telephone number we use to operate the Service at any time and will notify you of these changes. You acknowledge that any messages, including any STOP or HELP requests, you send to a short code or telephone number we have changed may not be received and we will not be responsible for honoring requests made in such messages.

(h) The wireless carriers supported by the Service are not liable for delayed or undelivered messages. You agree to provide us with a valid mobile number. If you get a new mobile number, you will need to sign up for the program with your new number.

(i) To the extent permitted by applicable law, you agree that we will not be liable for failed, delayed, or misdirected delivery of any information sent through the Service, any errors in such information, and/or any action you may or may not take in reliance on the information or Service.

7. Intellectual Property

(a) All content and materials on our website, including but not limited to text, graphics, logos, images, and software, are the property of The Gents Store or our licensors and are protected by copyright, trademark, and other intellectual property laws. 8. Limitation of Liability

(a) TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE GENTS STORE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM YOUR ACCESS TO OR USE OF OUR SERVICES.

(b) IN NO EVENT SHALL THE GENTS STORE’S LIABILITY EXCEED THE AMOUNT PAID BY YOU FOR THE PRODUCTS PURCHASED FROM OUR WEBSITE.
